As of Friday 23rd August, the CFMEU Construction Division was placed into administration by the Federal Government.
- For a period of up to five years, the Union’s democratic structure has been effectively abolished. This includes the Branch Council, Divisional Branch Management Committee (DBMC) and removal of full-time elected officers (Branch Executive).
- The full-time elected Victorian leadership, Derek Christopher, Elias Spernovasilis, Robert Graauwmans and Joe Myles have been dismissed. If he had not already resigned, the dismissals would have included the State Secretary John Setka.
- Across the country, approximately 270 officials have been removed from their elected positions.
- In Victoria, our Organisers, including those that held positions on the Branch Council and DBMC are still employed and will continue to represent you.
- All office staff remain employed and the office will operate as per usual.
- Our Delegates/Shop Stewards will continue to represent you to ensure your rights and health and safety are enforced on your site.
- On 29th August, the former Construction National Secretary, Dave Noonan was removed from the board of your superannuation fund, CBUS. His replacement is unknown.
- Please note, this administration is not financial, the Union’s current financial situation is strong. CFMEU Victoria will always fight for you, your wages and entitlements to make sure you return home safely to your loved ones.
The true power in your Union has always rested with the membership. This has not changed. We still have the power to stand up and fight back.

CFMEU Victoria is strongly committed to ensuring the rights and safety conditions of all our members are enforced:
- We understand the challenges that may come from being under administration and will have zero tolerance from any employers who try to exploit this. Any push back, delays or withdrawal from EBAs by employers will be heavily fought.
- We will continue to fight to defend and extend members’ wages and conditions and for health and safety on the job.
- We will continue to roll out EBA’s and will take protected industrial action against any employer who wants to take us on.
The rights, entitlements and safety of our members will always be our number one priority.
